Terms of use

These terms are between the dealership that uses Ooglecars (“you”) and Dave Mackay, trading as Ooglecars (“we”). Ooglecars is dealer management software for Australian used-car dealers. By creating an account, accepting an invite, or using the service, you agree to these terms and to the Privacy policy.

These terms cover the software. They are not the contract for the sale of a car. A retail buyer’s contract with your dealership is a separate document.

The service

We provide tools for stock, sales, paperwork and expenses and, where you turn them on, connections such as Xero and Gmail, plus an assistant that can read documents and answer questions about your yard. Features can change. We do not lodge a form with a government agency unless a screen in the product says that it does.

Your dealership

Accounts are invite-only. The owner is responsible for who is invited and what they can do. You must be allowed to act for the dealership. Keep sign-in details to yourself. You own the records you put in. You give us permission to host and process them so we can provide the service. You must have the right to upload customer, supplier and staff information.

You remain the dealer

You remain responsible for your motor dealer licence, the dealings register, contracts, notices, PPSR, GST and what you send to Xero. Ooglecars helps you prepare those records. Check them before you rely on them. Extracted fields, valuations and assistant replies can be wrong.

Google, Xero and other connections

Connecting Google or Xero is optional. You authorise us to use that connection only to provide the features to your dealership, as described in the Privacy policy. A Gmail draft is not sent until someone at your dealership sends it. Disconnect from Dealer profile → Email → Connection Inbox when you want Google access to stop.

Acceptable use

• Use the service for your dealership’s motor-dealing business.
• Do not try to open another dealership’s data.
• Do not break, probe or overload the service, and do not upload malware.
• Do not use the assistant to spend money or send a message unless you have confirmed that action in the product.
• Do not use the service to break Australian law.

Fees

If a subscription applies, the price is the one shown on the billing page before you pay. At the date of these terms the published plan is A$999 per month. You can manage the subscription from the billing page. If a payment fails we may suspend the yard after we have told the owner.

Australian Consumer Law

Nothing in these terms excludes a guarantee or right under the Australian Consumer Law that cannot be excluded. Where the law allows us to limit a remedy, our liability for breach of a non-excludable guarantee is limited to supplying the service again or paying the cost of having it supplied again.

Otherwise, to the extent the law allows, we are not liable for lost profit, for records you did not export, or for a failure of Google, Xero or another service you connected. Our total liability to a yard in a year is limited to the fees you paid us for that yard in the previous 12 months. We do not limit liability for fraud, or for any liability the law says we cannot limit.

Stopping

You can stop using Ooglecars and ask us to close the yard by emailing hello@ooglecars.com. Export the records you need first, including any dealings register you are required to keep. We can suspend or close a yard for non-payment, a serious breach, or a security risk, and we will tell the owner where it is reasonable to do so. On closure we delete or de-identify personal information we are not required to keep, as set out in the Privacy policy.

Law

These terms are governed by the laws of Australia. If we cannot resolve a dispute by email, it may be brought in the courts of the Australian state or territory where the dealership carries on business.

Changes and contact

We post updated terms on this page. If a change is material we will email the dealership owner where we have an address. Continuing to use Ooglecars after the date at the top of this page is acceptance of the updated terms. Questions: hello@ooglecars.com. The Terms of use and the Privacy policy are both public.
